Germany's constitutional court is set to hear a case on November 12 that could create new fiscal challenges for the ruling coalition government, according to Citi economist Christian Schulz. The case involves Germany's solidarity surcharge, a tax originally designed to fund infrastructure projects in the former East Germany.
Schulz notes that the court’s decision, which could come as early as spring, may have significant fiscal consequences, potentially affecting €63 billion in revenue, or about 1.5% of Germany's GDP. Citi anticipates an adverse ruling for the government, possibly reclassifying the surcharge from a temporary measure to boost investment into a permanent tax on high-income families.
However, Schulz adds that a retrospective ruling is unlikely, and that the new government will likely be able to address the issue in a fiscally neutral manner.
